Desert Properties Inc. v. G&T Martini Holdings Ltd.

In this case, the Court of Appeal confirmed that the timeline for appealing an arbitration award under the Arbitration Act, S.B.C. 2020, c. 2 is 30 days from the date of a corrected arbitration award.

The court confirmed that this interpretation of section 60(1) of the Arbitration Act is consistent with the practicalities of appealing an arbitration award and limits needless litigation about whether an appeal is substantively based on the original award, or on a correction or interpretation. The Court accepted NST’s submissions on this issue, clarifying an important point of procedure relating to arbitration practice that was not previously clear under the relatively new British Columbia Arbitration Act.
