James C. MacInnis, K.C. and Edith Chen act for The9 Limited and its subsidiary in connection with their claim against Skychain Technologies Inc. for defaults under a Financing Agreement and a General Security Agreement arising from the proposed development of a cryptocurrency mining facility.  The9 is a public company (Nasdaq: NCTY), as is Skychain (TSXV:SCT).  In September 2022, NST obtained judgment in favour of The9 for $2 million, after the Court rejected Skychain’s position that The9 was limited to liquidated damages under the terms of the Financing Agreement.  On April 6, 2023, the B.C. Court of Appeal upheld that result in a unanimous judgment, reported here https://www.bccourts.ca/jdb-txt/ca/23/01/2023BCCA0150.htm  The Court of Appeal agreed with NST’s position that The9 was entitled to accelerate its debt for default and to declare the full amount of the debt immediately due and owing.
